Jesús Reyna García, the former acting governor in Michoacán, has been released from jail after being imprisoned since 2014, when he appeared ion a video along Servando Gómez Martínez “La Tuta”, the leader of the “Caballeros Templariosdrug cartel. His release has called the reliability of the Mexican justice system into question once again, as well as the efforts made by different administrations to eradicate cancers and the moral rot that emerges inside the Mexican government from time to time.

Something the justice system lacks in Mexico is its capacity to investigate and present solid evidence before justice. This has been documented by experts and national and international organizations. There are many cases where the accused is freed because the evidence is flimsy or even worse because the case was dominated by political interests.

The spectacular operations to arrest public servants tend to become major setbacks for those who ordered it, usually, because the evidence is weak and not properly structured even if their responsibility or complicity, or their innocence in some cases, in crimes is evident, especially in the diversion or embezzlement of public funds. The evidence building is so inefficient that those in charge of passing sentence can't find solid support to issue a verdict, which results in the freedom of alleged criminals, such is the case of Reyna García. These make all the effort and the dissemination of their arrest and presentation before justice look foolish.

The new President and his team have the opportunity to change the paradigm that has prevailed in the last 12 years of “war against crime.” The federal government's incursion in states has been successful in very few occasions. Felipe Calderón and Enrique Peña Nieto's failure in the persecution of acts of corruption and links between state governments and organized crime should be taken by President Andrés Manuel López Obrador as an alert sign and an example of what should be done in this field. The discussion about the National Guard opens to door for a healthy debate.
